NOAA lists ringed and bearded ice seal populations under the Endangered Species Act

Dec. 30, 2012 ? NOAA Fisheries announced on December 21, in compliance with a court ordered deadline, its final listing decision for four subspecies of ringed seals and two distinct population segments (DPSs) of bearded seals under the Endangered Species Act. Specifically, in line with the proposal, NOAA will list as threatened the Beringia and Okhotsk DPSs of bearded seals and the Arctic, Okhotsk, and Baltic subspecies of ringed seals. The Ladoga subspecies of ringed seals will be listed as endangered. The species that exist in U.S. waters (Arctic ringed seals and the Beringia DPS of bearded seals) are already protected under the Marine Mammal Protection Act.

This science-based listing decision will not result in any immediate restrictions on human activities; however, Federal agencies that permit or fund projects that may affect a listed species must consult with NOAA Fisheries to ensure the existence of the species is not jeopardized. In addition, this listing will have no impact on the subsistence harvest of ice seals by Alaska Natives, a practice that is central to the traditional culture and nutrition in many Alaskan Native coastal communities.

"Our scientists undertook an extensive review of the best scientific and commercial data. They concluded that a significant decrease in sea ice is probable later this century and that these changes will likely cause these seal populations to decline," said Jon Kurland, protected resources director for NOAA Fisheries' Alaska region. "We look forward to working with the State of Alaska, our Alaska Native co-management partners, and the public as we work toward designating critical habitat for these seals."

NOAA will work with local, state and Native partners, as well as the public to help determine whether to propose critical habitat designations for Arctic ringed seals and the Beringia DPS of bearded seals. This decision will happen at a later date, after compiling significant additional scientific and economic data and public input. Earlier this year, the President directed that any future designations of critical habitat carefully consider all public comments on relevant science and economic impact, including those that suggest methods for minimizing regulatory burdens. Any potential future critical habitat designation will include a full analysis of economic impact, including impact on jobs, and will strive, to the extent permitted by law, to avoid unnecessary burdens and costs on states, tribes, localities, and the private sector.

Ringed and bearded seals depend on sea ice and snow to survive. After a comprehensive review of the best available science including climate models developed by the Intergovernmental Panel on Climate Change, NOAA has concluded that sea ice and snow cover are likely to further decrease in the foreseeable future resulting in population declines that threaten the survival of these seals.

Ringed seals nurse and protect their pups in snow caves, which are threatened by late ice formation in the fall, rain-on-snow events in the late winter, earlier break-up of spring ice, as well as decreasing snow depths, which are projected to be too shallow for snow cave formation by the end of the century. Both ringed seals and bearded seals rely on sea ice for extended periods during molting, and bearded seals live on sea ice during critical months for breeding, whelping, and nursing. Sea ice is projected to shrink both in extent and duration, with bearded seals finding inadequate ice even if they move north.

NOAA Fisheries proposed the listings in December 2010 and provided opportunities for public input through public comment periods and during public hearings held in Anchorage, Barrow, and Nome. In accordance with NOAA's Policy for Peer Review in ESA Activities, the agency also solicited comments from peer reviewers on each of the proposed rules. In December 2011, NOAA administratively extended the deadline for final listing determinations six months to June 2012 to allow for additional consideration of relevant science and information. In November 2012, the Alaska district court ordered NOAA to respond to a complaint about further delay by December 21, 2012.

The Endangered Species Act defines an endangered species as "any species which is in danger of extinction throughout all or a significant portion of its range." A threatened species is "any species which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range."

The Endangered Species Act requires species listed as endangered to receive the full protection under the Act to prevent extinction, including a prohibition against "take," which includes harassing, harming, pursuing, wounding, killing, trapping, capturing, or collecting. These protections may also be established for threatened species to prevent them from becoming endangered, but NOAA does not propose pursuing such a rule at this time.

NBC seizes ratings lead with football and 'Voice'

NEW YORK (AP) ? Powered by football and "The Voice," NBC took the lead in the ratings last week.

But even football couldn't tackle CBS' indomitable "NCIS," which edged out the Seahawks-49ers clash to become the week's most-watched show. It drew 19.6 million viewers, the Nielsen Co. said Thursday.

In third place was "NCIS: Los Angeles," followed by the season finale of "The Voice." The season finale of Fox's singing competition "The X Factor" ranked 14th.

Among several Christmas specials, "A White House Christmas: First Families Remember" was the most-watched, ranking 20th place.

A preview airing of a new NBC sitcom, "1600 Penn," ranked 23rd with 6.9 viewers. It premieres next month.

Overall for the week, NBC averaged 8.12 million viewers in prime time (4.9 rating, 8 share). CBS ranked second with 7.50 million viewers (4.9 rating, 8 share), while Fox had 5.64 million (3.3 rating, 6 share), ABC had 4.78 million (3.0 rating, 5 share), the CW had 1.43 million (.9 rating, 1 share) and Ion had 1.12 million (.8 rating, 1 share).

Among the Spanish-language networks, Univision led with an average of 3.21 million viewers (1.7 rating, 3 share). Telemundo had 1.24 million (0.6 rating, 1 share), TeleFutura had 740,000 (0.4 rating, 1 share), Estrella had 270,000 (0.1 rating, 0 share) and Azteca had 140,000 (0.1 rating, 0 share).

NBC's "Nightly News" topped the evening newscasts with an average of 9.1 million viewers (6.1 household rating, 11 share). ABC's "World News" was second with 7.9 million (5.3 rating, 10 share) and the "CBS Evening News" had 7.0 million viewers (4.6 rating, 9 share).

A ratings point represents 1,147,000 households, or 1 percent of the nation's estimated 114.7 million TV homes. The share is the percentage of in-use televisions tuned to a given show.

Woodbury House Fire Displaces Family Of 4 ? CBS Minnesota

WOODBURY, Minn. (WCCO) ? Authorities say a family of four is now without a home after a fire caused heavy damage at the residence Thursday morning in Woodbury.

Crews responded to a report of a house fire at about 1:30 a.m. Thursday on the 4500 block of Woodbury Drive. As many as four fire departments had to be called to the scene to help put the fire out. When authorities arrived, the fire was heavy on the second floor of the home and appeared to be spreading to the attic. Authorities said the fire broke about above the chimney in the attic space and burned through the roof of the home.

Authorities said the home is no longer livable.

There was nobody inside the home at the time of the fire and no firefighters were hurt battling the blaze. Authorities said the cause of the fire is still under investigation. The Woodbury Fire Department was assisted at the scene by departments by Lake Elmo, Cottage Grove and St. Croix Valley.

Fire officials said the fire serves as a reminder to have your chimney inspected annually.

Private company to offer rides to moon by 2020

Golden Spike says it hopes to sell missions to the moon for over $1 billion.

A new private venture aims to sell manned trips to the moon by 2020, its founders announced today (Dec. 6).

The company, called Golden Spike (after the final spike built into the First Transcontinental Railroad), plans to sell each moon mission for about $1.5 billion ? a relative bargain, said the company's president and CEO Alan Stern, a former director of NASA?s Science Mission Directorate.

For the same price as many unmanned robotic missions, Golden Spike will provide a round trip for two humans to the moon.

"We're selling to nations, corporations and individuals," Stern told SPACE.com. "Get in line ? and I think it's going to be a long one." [How Golden Spike's Moon Landing Plan Works (Infographic )]

Stern and Golden Spike's chairman of the board of directors, Gerry Griffin, a former Apollo flight director and NASA Johnson Space Center director, announced their plans today at the National Press Club in Washington, D.C.

Shopping for a rocket

The company's leaders have not yet chosen a launch vehicle or space capsule to transport their passengers; Stern expects to make the final selections in 2014.

To keep costs low, Golden Spike will likely use existing or already-under-development rockets and spacecraft. However, the company will need to commission its own lunar lander and specially designed spacesuits. Stern called rumors that Golden Spike had already chosen SpaceX's Falcon 9 Heavy rocket "not true."

The company has been in the works, and under wraps, for two and a half years, Stern said.

"I don?t think anybody's got us beat," he added. "This is state-of-the-art cool."

The missions are being targeted at countries without their own space agencies or that can't afford to launch people to the moon independently, as well as scientific organizations and even private individuals looking to take the trip of a lifetime.

"We have spoken to space agencies from both Asian and European countries and found real interest," Stern said.

US governor vetoes bill allowing concealed weapons in churches, schools, daycares

DETROIT - Michigan Gov. Rick Snyder has vetoed legislation that would allow concealed weapons in churches, schools and daycare centres.

The Republican governor told The Associated Press Monday he was scrutinizing the bill after Friday's massacre at a Connecticut school. He also drew on his own memories of a fatal shooting in his college dormitory more than three decades ago.

Snyder said in a release Tuesday that public venues need clear legal authority to ban firearms "if they see fit to do so."

The legislation would have prohibited openly carrying guns in churches, schools and daycare centres while allowing permit holders to carry concealed weapons. But they couldn't if the locations declare themselves weapons-free zones.

Under Michigan law, people may openly carry guns in those and other locations but not concealed weapons.

Dinosaur: First freshwater mosasaur discovered

Dec. 19, 2012 ? A new mosasaur species discovered in Hungary is the first known example of this group of scaled reptiles to have lived in freshwater river environments similar to modern freshwater dolphins, according to research published December 19 in the open-access journal PLOS ONE by Laszlo Makadi from the Hungarian Natural History Museum, Hungary and colleagues from the University of Alberta, Canada and MTA-ELTE Lend?let Dinosaur Research Group, Hungary.

The species lived about 84 million years ago, the largest specimens reached about 20 feet in length, and belongs to a family called 'mosasaurs', conventionally thought of as gigantic finned marine lizards, similar and perhaps even related to present day monitor lizards. The researchers discovered several fossils of the new species, ranging from small juveniles to large adults that suggest that this species had limbs like a terrestrial lizard, a flattened, crocodile-like skull, and a tail unlike other known members of the mosasaur family.

The fossils were recovered from an open-pit mine in the Bakony Hills of Western Hungary, which were once flood-plains. According to the study, this is the first known mosasaur that lived in freshwater, and only the second specimen of a mosasaur to have been found in rocks that were not once deposited in the ocean. Makadi says, "The evidence we provide here makes it clear that similar to some lineages of cetaceans, mosasaurs quickly adapted to a variety of aquatic environments, with some groups re- invading available niches in freshwater habitats. The size of Pannoniasaurus makes it the largest known predator in the waters of this paleo-environment."

Even in the modern world, scaly reptiles in the aquatic world are extremely rare. Only a few species live in the water, and even fewer, like marine iguanas and sea kraits, live in the oceans. The new species described here probably adapted to freshwater environments similarly to river dolphins, such as those now inhabiting the Amazon, Ganges and Yangtze rivers.

Accessories Before the Fact, Section 346 of the Crimes Act 1900 ...

Section 346 of the Crimes Act 1900 deals with accessories before the fact- those who were not present when the act was committed but counseled or procured the offender to commit the crime. Under section 346, an accessory before the fact for a serious indictable offence may be charged as a principal offender and is liable for the same penalties as the principal offender. Section 346 states:

Every accessory before the fact to a serious indictable offence may be indicted, convicted, and sentenced, either before or after the trial of the principal offender, or together with the principal offender, or indicted, convicted, and sentenced, as a principal in the offence, and shall be liable in either case to the same punishment to which the person would have been liable had the person been the principal offender, whether the principal offender has been tried or not, or is amenable to justice or not.

As can be seen from above, an accessory before the fact may be charged and convicted for the offence even if the principal offender has not been tried.

Patients with diabetes may not receive best treatment to lower heart disease risk, study suggests

Dec. 18, 2012 ? For some people with diabetes, there may be such a thing as too much care. Traditional treatment to reduce risks of heart disease among patients with diabetes has focused on lowering all patients' blood cholesterol to a specific, standard level. But this practice may prompt the over-use of high-dose medications for patients who don't need them, according to new research from the VA Ann Arbor Healthcare System (VAAAHS) and the University of Michigan Health System.

The study encourages a more individualized approach to treatment that adjusts treatment according to the patient in order to improve the quality of care. The findings appear in Circulation: Cardiovascular Quality and Outcomes.

Authors also suggest that blanket goals routinely used to lower heart attack risks may unnecessarily expose some patients to potential adverse side effects of high-dose medications. Researchers also note that when these standard goals are used to assess whether a health provider delivered high quality care, they may encourage overly aggressive treatment.

"We want patients to get the treatment they need to prevent heart attacks and cardiovascular issues but we don't want to expose them to additional treatment risks without strong evidence of the benefits," says senior author Eve Kerr, M.D., director of the Center for Clinical Management Research at the VAAAHS, professor of internal medicine at the U-M Medical School and a member of the U-M Institute for Healthcare Policy and Innovation.

"We need to move away from a one-size-fits-all performance measure that misses the point of providing appropriate treatment."

Managing cholesterol is especially important for people with type 2 diabetes who often have an increased risk for a heart attack. This is especially true for people age 50 and over.

Physicians commonly aim to lower blood cholesterol for all patients with diabetes to below 100 mg/dl. Recent evidence, however, highlights the importance of individualized treatment for each patient that's not focused on bringing cholesterol levels down to a set value.

In the new study, researchers found that 85 percent of veterans age 50-75 with diabetes treated at the VA received appropriate care, most importantly because they were on at least moderate doses of cholesterol treatment medications called statins. But among patients 18 and older who had no known heart disease, nearly 14 percent may have unnecessarily received high-dose statin medications, putting them at risk of harm from overtreatment.

The research stems from new safety data published this year by the U.S. Food and Drug Administration (FDA) on commonly-used cholesterol-lowering medications known as statins. The FDA issued new guidelines for statin drugs warning users that the medications can cause memory loss, elevated blood sugar levels, and type-2 diabetes, in addition to muscle damage and liver disease.

"The study reveals that we may have both underuse and overuse of statins and should invigorate efforts to make sure that each patient has the opportunity to be treated in a personalized way that is best given their risk profile," says Circulation Editor and Director of the Yale-New Haven Hospital Center for Outcomes Research and Evaluation Harlan M. Krumholz, M.D.

Authors says modern healthcare electronic record systems that combine blood pressure, prescription and other health data on individual risks such as heart disease make this method of individualized treatment possible.

The study included more than 960,000 active Veterans Affairs primary care patients 18 years of age or older with type 2 diabetes treated from July 2010 to June 2011.

Google Porn Just Got More Difficult To Search For

For years, even the most innocent of Google searches might have pulled up a naughty picture or link. But thanks to a new tweak to Google's search algorithm that seems to have taken effect on Wednesday in the U.S., your Google inquiries are totally SFW -- unless you don't want them to be.

In other words: Google just made it harder to find porn.

Google changed the computer program that spits back links and images when you type in a search phrase, Casey Newton at CNET reports. While sexually explicit material is not completely blocked from the Internet's most popular search portal, users will find it only if they make their searches very specific.

"If you're looking for adult content, you can find it without having to change the default setting -- you just may need to be more explicit in your query if your search terms are potentially ambiguous," a Google rep told CNET.

Previously, a web search for something as simple as, say, a common term for "breast" would have yielded some links to pornographic sites in the very top results. No longer:

Unsurprisingly, the Reddit community was among the first to notice the change. Redditors experimented with amending words to the above search to finally get pornographic results. Here's what happens with a search for "boob porn":

We'll tell you that the same thing happens with Google Image search. Whereas previously an image search for "boobs" gave pictures of women in various states of undress, now the results only show clothed women.

Other tech blogs, including The Verge and The Next Web, note that Google's Safe Search feature, which lets users decide if they want searches to include explicit material or not, has been altered, too.

Before the filter on searches could be set "strict," moderate" or be completely turned off. That last option could give users porn results for even the most unoffending searches. But with the change Wednesday, there is now a box labeled "Filter explicit results," which you can click to check or unchecked. Even when left unchecked, images results after typing in "boobs" show no nudity.

If you believe this is censorship on Google's part (the company denies that charge), there are always other search engines you can use. It's just as easy as ever to search for porn on Bing, where its SafeSearch feature can still be turned entirely off. Or you could always try Search.xxx, a recently launched search engine that returns only porn results.

Violence in Mali threatening survival of endangered elephants

Dec. 12, 2012 ? University of British Columbia and Oxford University researchers have revealed the secrets of survival of an endangered population of African elephants in the unforgiving Sahara desert. The animals have the largest migration among elephants, the study finds, but recent violence in Mali may now be putting them at risk.

A two-year study, to appear in January's edition of Biological Conservation, tracked the elephants' migration with Global Positioning System (GPS) collars. Its findings advance conservation efforts for the animals, which are facing increased armed conflict in Mali between government forces and Touareg rebels.

"In recent years, the Mali elephants have largely managed to maintain their numbers in extreme natural conditions of heat and drought," says lead researcher Jake Wall, a UBC Dept. of Geography PhD candidate, whose study received support from Save The Elephants, a Kenya-based conservation group. "The uprising occurring in northern Mali puts them at greater risk, as does increasing human settlement in their traditional territory and the growing risk of ivory poaching."

The study focused on the Gourma elephants of Mali's northern region, which are arguably the world's toughest elephants. The desert-adapted species frequently endure sand storms, water shortages, and temperatures over 50 degrees Celsius (122 Farenheit). Hunting, drought and climate changes have reduced their population to an estimated 350 elephants.

The study reveals the elephants travel more than 32,000 square kilometers annually in search of food and water -- the largest area ever recorded for any elephant species.

The elephants spend concentrated periods in several key areas and rely on a network of pathways, including a critical sandstone passage known as "la Porte des Elephants." The study identifies 10 "hot spots" essential for their survival that should be protected for conservation purposes.

Backgrounder: Ivory poaching

Gourma elephants have largely been spared from the ivory poaching crisis ravaging elephant populations across Africa, but at least three have been killed this year. Profits from the illegal ivory trade are believed to fuel terrorist groups like Al-Shabaab, the Janjaweed and the Lord's Resistance Army, experts say.

An anti-poaching initiative by the International Conservation Fund of Canada and the WILD Foundation is engaging local communities and national foresters in defense of elephants, says co-author Iain Douglas-Hamilton, an Oxford University zoology researcher and founder of Save the Elephants.

Backgrounder: Gourma elephants

Gourma elephants are believed to be the northernmost population of elephants in the world. They have historically enjoyed relatively peaceful coexistence with the local Touareg, Fuhlani and Dogon peoples, but conflict between humans and elephants over space and resources are increasing as local peoples shift from pastoralism to agriculture settlements.

A surprise study finding is that male and female elephants share only a quarter of their ranges. "We think the difference is partly because of their tolerances towards people," Wall says. "Bulls generally take more risks and occupy areas that have higher human densities. They also have varying food strategies and we think that differences in the areas they occupy might be because of different vegetation types in those areas."

Although Gourma elephants walk similar linear distances to their East and Southern African relatives, their movements are spread out over an area 150 per cent larger than those reported in Namibia, and 29 per cent larger than elephants in Botswana. Researchers believe their epic migration is due to the scarcity of food and water in the region, and suggest it may be forced to expand further as resources become scarcer.

Research co-authors include Brian Klinkenberg and Valerie LeMay of UBC and George Wittemyer of Colorado State University.

Fan Fiction - After the Copyright Modernization Act : Entertainment ...

When we last discussed "fan fiction" here at the Signal back in early 2010 (Fan Fiction - Perspectives on Fiction and Its Fans) it was noted that the considerations to be taken into account when discussing fan fiction were a mix of legal, artistic and commercial.? But with the proclamation into force on November 7, 2012 of many provisions of the Copyright Modernization Act (Bill C-11), we need to supplement our earlier observations.? Post-CMA there is a new legal consideration to address when discussing fan fiction and Canadian copyright law: new Section 29.21 of the Copyright Act, the "non-commercial user-generated content" provision (referred to in this post as the "UGC exception").

During the debates over Bill C-11 (and its predecessor, Bill C-32), what would become Section 29.21 of the Copyright Act gained a somewhat misleading moniker: it was often referred to as the "YouTube" or "mashup" exception to infringement.? While neither term is inaccurate, they both carry the innuendo of being relevant only to digital activities - but the UGC exception is in no way limited to online or digital activities.? Fan fiction, described on Wikipedia as "stories about characters or settings written by fans of the original work, rather than by the original creator", seems to be capable of being sheltered under the provisions of the UGC?exception, which permits an individual to use elements of an existing published work to create and disseminate to the public a new work so long as the following criteria are met:

  • the use of, or the authorization to disseminate, the new work or other subject-matter is done solely for non-commercial purposes;

  • the source ? and, if given in the source, the name of the author, performer, maker or broadcaster ? of the existing work or other subject-matter or copy of it are mentioned, if it is reasonable in the circumstances to do so;

  • the individual had reasonable grounds to believe that the existing work or other subject-matter or copy of it, as the case may be, was not infringing copyright; and

  • the use of, or the authorization to disseminate, the new work or other subject-matter does not have a substantial adverse effect, financial or otherwise, on the exploitation or potential exploitation of the existing work or other subject-matter ? or copy of it ? or on an existing or potential market for it, including that the new work or other subject-matter is not a substitute for the existing one.

Many observers have noted the potential impact of the UGC?exception on the legal analysis of fan fiction, among them Tara Parker ('Transmedia' a Copyright Grey Area) and the Writers' Rights Coalition of Canada (Brief on Bill C-32).? (The urtext of Canadian legal analysis of fan fiction, and a must-read for anyone interested in the topic, Grace Westcott's "Friction Over Fan Fiction", was written in 2008, before the UGC?exception had been incorporated into the predecessors of the CMA.)? Among lengthier treatments of the UGC exception and fan fiction, Graham Reynolds' "Towards a Right to Engage in the Fair Transformative Use of Copyright-Protected Expression" (Chapter 13 of From "Radical Extremism" to "Balanced Copyright": Canadian Copyright and the Digital Agenda) provides a comprehensive consideration of the matter.? Although they do not speak about fan fiction in particular, Daniel Gervais' "The Tangled Web of UGC: Making Copyright Sense of User-Generated Content" and Len Glickman and Jessica Fingerhut's "User-generated content:?Recent developments in Canada and the U.S." also provide thoughtful discussions about user-generated content more broadly.?

A discussion of the legal implications of fan fiction would not be complete without mentioning two relevant matters which are not affected by the UGC?exception introduced by the CMA: moral rights and trade-mark (or passing off) claims.? Under Canadian copyright law, authors possess moral rights, one of which is the right of "integrity", or, as it is articulated in Section 28.2 of the Copyright Act, the right to prevent (or seek recompense for) any distortion, mutilation or other modification of a work which prejudices the author?s honour or reputation.? The UGC?exception, while creating an exception to copyright infringement, has no effect on an author's potential moral rights claims.? And because fan fiction may make use of elements of an author's creation such as titles, character and location names to which some form of trade-mark protection applies (e.g., Star Wars fan fiction that makes use of character names like Luke Skywaylker (a registered mark in Canada), Darth Vader (ditto) or world elements like lightsabers, droids or Ewoks (each either currently or previously a registered mark in Canada), there remains the possibility that some form of trade-mark based action could be commenced by the relevant rights-owner.

Some Quick Sage Advice for Young Employees Early in Their Careers

My wife & I have a close friend who recently entered the workforce for his first-ever job. On his first day of work my wife was kind enough to write down words of wisdom from her years on the job.

I don?t write about Tania very often ? mostly at her request. Otherwise I?d shout from the mountain tops how smart & capable she is. She?s a Brown undergrad, Wharton MBA, ex strategy consultant and ex Googler. She?s worked for L?Oreal, Accenture, Virgin Mobile & BSkyB (one of the leading media companies in the UK).

She is the disciplined, organized and detail-oriented member of the Suster household. And she?s one hell of mom, with her super-motivational schoolwork & music completion charts with daily measurements and appropriate rewards for hitting milestones.

You know now why I would take her advice for new employees. She?s ?type A? and I?m ?type ADD.?

She gave me a special one-time permission to write about her in a blog post so I could publish the advice she gave our friend. So consider this my first-ever guest blog post. With a tiny bit of ghost writing from me . Cheesy stock photo mine, not hers.

General Advice

  1. Don?t expect constructive feedback without asking directly for it. Most businesses have formal programs in place to give you feedback. Most bosses are too busy to put in the real effort to help you. Many just ask you to fill out the forms for them. It becomes more administrative than constructive. If you ask for feedback in a pleasant, non-defensive way you will likely get it.
  2. You won?t really have a mentor unless lightening strikes. But if you seek one out, most talented employees would gladly become your informal mentor. This can be your most valuable career management tool so use it. It can be a great way to build advocates that will move mountains for you in the future.
  3. People won?t communicate expectations clearly (you must ask, clarify, ask again). Knowing the expectations of your senior employees (and peers) is invaluable to your success and asking people?s expectations is the clearest way to get them to think about it in the first place. The easiest way to beat expectations is for you and your boss to agree them two-ways and check on progress periodically.
  4. Constructive criticism stings, but we all need it. So seek it out, push for real feedback and be open to hearing it whether you agree or not. If you?re defensive you?ll never get real criticism. It?s much easier for your boss to avoid the confrontation or putting the time into thinking through what you could do better.
  5. Don?t overly rely on HR. Make your boss and her boss your primary allies. Your career is best navigated though line managers. HR should be able to manage the sensitive information you give them separate from your line managers but in my experience they do not so be careful. They are not your free psychoanalysts.
  6. Show up early. You may be a morning person ? you may not. But nothing gets noticed more than which employees constantly turn up late. Even if bosses say they don?t care ? they do. Nothing tarnishes your reputation more quick than being THAT person. The one always slipping in late.
  7. Be humble. Nobody cares where you went to school or how great of a student you were. Get over yourself. Don?t be arrogant. Don?t try to act like a managing partner from day 1. It?s OK to be junior. Nobody expects you to be managing the whole division. In fact, they?ll resent you if you try to act like you are.

Working with Your Boss

Sit down with your boss asap and tell her you want to do an amazing job. Ask her:

  • What could I do to exceed your expectations? What have past employees done that made your life much easier? What tips would you pass along from the most successful employees who have had this job?
  • What is the worst thing I could do in this job that you want me to avoid?
  • Whom should I emulate? Who is great in this role that I should learn from?
  • How can I best help you?

What is Your Job, Really?

  • Your job is to make your boss?s job easier ? to help your boss succeed. ?Always have that in mind even if it?s not in your immediate job description
  • NEVER bring your boss a problem without bringing him a few potential solutions (I wrote about this here ?Bring Me Problems, Not Solutions?).?Be associated with problem solving, not problems, it creates a positive halo around you
  • Say ?yes? to work even when don?t want to. Everybody loves employees who take on projects with enthusiasm. The world is filled with people who sigh when assigned work.
  • BUT if you do become overwhelmed with work it?s ok to say ?I need your help prioritizing my tasks because I have too much on my plate.? ?Make it a positive thing. The worst thing is to take on too much work and under-deliver.

Other Notes

  • Schedule in your calendar and in your bosses calendar a few check in meetings and ask for feedback and make it a formal conversation. Prepare them in advance by providing a list of the things you?re working on developing and tell them you?d love feedback on how to improve at those things. ?You might want to preface with??I want to learn how I?m doing so I can improve, please give me constructive criticism!? Mostly you don?t want them to feel like these meetings are obligations, reasons for hours of preparations or ways for you to be defensive about your job.
  • So take the feedback on and don?t get defensive. The more you get positive measurement on your work the more likely your boss will be aware of it at the annual review time. Make sure to thank you for his time (he is likely busier than you are, after all!)
  • After you feel stable in your role and with your relationship with your boss ? make sure to get to know your boss?s boss. Don?t let your boss love you but his boss not know who you are! This WILL come in handy in your career but you have to manage this cautiously.

Russian assembly set for tough response to U.S. rights bill

MOSCOW (Reuters) - Russia's foreign minister urged parliament on Sunday to agree a tough response to a U.S. law punishing Russian human rights violators, increasing the risk of a chill in relations with Washington.

Moscow announced restrictions on meat imports from the United States on Friday although it denied suggestions it had done so in response to the U.S. Senate's passage a day earlier of the so-called Magnitsky Act.

Foreign Minister Sergei Lavrov said the parliament should now respond and Alexei Pushkov, a senior parliamentary deputy from President Vladimir Putin's party, said the State Duma lower house would discuss retaliatory measures this week.

"As this is an attempt to interfere in our internal affairs, I would be very interested in a reaction by the state Duma that would be collective, on a multi-party basis and representing all party groups," Lavrov said in televised remarks.

Puskhov, who heads the chamber's foreign affairs committee, said a majority of lawmakers wanted a tough response, calling for visa restrictions on U.S. citizens who have violated human rights. He did not say who this might include or what rights violations they were accused of making.

"The Americans have reminded us about the way Russia is viewed on Capitol Hill," Yuri Ushakov, a foreign policy adviser to Putin, was quoted as saying by Interfax news agency.

"Stereotypes about our country persist and no one can get rid of them. So the Americans have made an extremely unfriendly move against us."

President Barack Obama, who launched a "reset" in relations with Russia less than four years ago, is likely to sign the Magnitsky legislation, which will test his and Putin's resolve to improve relations since both won elections this year.

The new U.S. legislation would bar visas for Russian officials linked to the 2009 death in custody of Sergei Magnitsky, a Russian lawyer who accused federal investigators of stealing $230 million from the state.

Lavrov told U.S. Secretary of State Hillary Clinton on Thursday that Russia would bar entry for Americans "guilty of crude human rights abuses."

Moscow has also warned it would respond with "asymmetrical" measures. Areas in which the United States wants Russian cooperation most include nuclear arms control and Iran.

DAMAGE MAY BE LIMITED

But there are also signs that Putin, back in the presidency since May, wants to limit the damage to relations with Russia's former Cold War enemy.

Political analysts say the Magnitsky Act will probably not derail Russian assistance on Afghanistan, affect diplomacy aimed at curbing Iran's nuclear program, or deepen disputes over U.S. missile defense and the conflict in Syria.

Moscow is trying to ensure its interests are protected in Syria. Despite frequent denials that it is shifting position, Moscow appears to be preparing for when President Bashar al-Assad leaves power.

The Senate approved the "Magnitsky Act" as part of a broader bill to lift a Cold War-era restriction and grant Russia "permanent normal trade relations, " or PNTR.

Despite Russian denials, analysts saw a link between the Magnitsky Act and Moscow's announcement of restrictions on meat imports from several countries, including the United States.

In a joint statement on Saturday, U.S. Trade Representative Ron Kirk and Agriculture Secretary Tom Vilsack said Russia's new requirement for imported beef and pork to be certified free of ractopamine, a feed additive used in the U.S. meat industry but banned in some other countries, appeared to be a violation of Moscow's obligations to the World Trade Organisation.

The move could potentially make producers from the United States, which exports more than $500 million a year worth of beef and pork to Russia, less competitive, giving an advantage to China and the European Union, where ractopamine is banned.

Russia's plant and health regulator, Rosselkhoznadzor, said it had warned over a year ago about the "inadmissibility" of meat with ractopamine to Russia.
